Bush: Miers' Religion Cited in Court Nod

"People are interested to know why I picked Harriet Miers," Bush told reporters at the White House. "Part of Harriet Miers' life is her religion."

This ought to be a pretty easy point to make. From the US Constitution:

Article. VI.

Clause 3: The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

If Bush really meant what he said about choosing Miers, her nomination is automatically dead. It's clearly in violation of the Constitution. For that matter, so was invading Iraq, both times, and Vietnam, or Grenada, or Yugoslavia, Panama, Haiti, you name it. Pretty much any invasion without an official declaration of war from Congress violates the Constitution, and Congress hasn't worried about that for decades, so I don't expect our nation's Senators to really be all that worried about it in this particular instance. Still, if Miers is confirmed, she'll be serving illegally. Perhaps that might be grounds for throwing her off the bench someday.
